Welcome to the Member Agreement (the “Agreement” or “Member Agreement”) for We Are Our World, LLC. This Agreement describes the terms and conditions applicable to your use of our services available under the domain and subdomains of weareourworld.com (the “Site”). If you do not agree to be bound by the terms and conditions of this Agreement, do not use or access our services and do not register to be a member of We Are Our World.

You must read, agree with and accept all of the terms and conditions contained in this Member Agreement, which includes the terms and conditions expressly set out below and those incorporated by reference, before you may become a member of We Are Our World. We strongly recommend that, as you read this Member Agreement, you also access and read the information contained in other pages of the We Are Our World – Privacy Policy, Invite-A-Friend Program and FAQ’s (collectively known as “Agreements”), as they may contain further terms and conditions that apply to you and a better understanding as a We Are Our World Member/User. Please note: Underlined words and phrases are links to these pages. By accepting this Member Agreement, you agree that your use of the We Are Our World Site and other future We Are Our World Sites will be governed by the Agreements posted on this Site.

We may amend these Agreements at any time by posting the amended terms on the Site. Except as stated below, all amended terms shall automatically be effective 10 days after they are initially posted on the Site. Please check these terms periodically for changes. In addition, we may notify you in accordance with your Email Notification Preferences. This Agreement may not be otherwise amended except in a writing signed by you and We Are Our World, LLC. Your continued use of We Are Our World Services following the posting or changes to the terms contained within all Agreements constitutes that you accept any changes contained within. These Agreements are effective upon acceptance in registration for new registering members and are otherwise effective on May 1st, 2025 for all members.

Overview:

We Are Our World, LLC., is a website where you can also be part of a viral marketing campaign that is all about empowering, encouraging and inspiring people to make a difference! While it will be a website with a network into learning more about our products and making purchases of those products, it will also be a way to raise money where 5-10% (depending on Your % Charity Settings) of your purchase $Amount will be contributed to the Charity of your choice – You will not pay anything extra! 100% of this money raised will be donated by We Are Our World, LLC directly to every charity that our members choose. Also, you will earn 0-10% (depending on Your % Cash-Back Settings) of your purchase $Amount on every purchase you make that can be used for future purchases on weareourworld.com or cash out to your personal bank account. Plus, you’ll be incentivized with a monetary reason to nourish this community to stand collectively together by simply inviting and referring others to become members of We Are Our World and you’ll earn 0-10% (depending on Your % Invite-A-Friend Settings) of the $Amount of all of their purchases which you can cash out to your personal bank account as well. It is our hope through this social enterprise, purpose-driven and synergistic movement that charities will have an influx of money donated, thereby being able to help people, speed up research, and/or find cures that they have set out to accomplish. It will truly be a community of giving, where you make a difference in your life and the life of others and everybody wins!

We Are Our World, allows its members/users to access its site, make purchases, refer others and support its charities in this unique manner (collectively known as “We Are Our World Services”). This Member Agreement applies to We Are Our World Services, as well as any new products, Site Offerings or Services that we may add in the future (unless stated otherwise).

Membership Eligibility & Requirements:
We Are Our World Services are offered to all individual persons worldwide who at the time of registration have reached the age of majority of the jurisdiction in which they reside. Our services are available only to, and may only be used by individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to minors (persons under the age of 18).

We Are Our World Invite-A-Friend Program and Membership:
To become a member of the We Are Our World Invite-A-Friend Program, you must make a purchase of a product or service. One, then becomes automatically enrolled upon registration as a member in We Are Our World. You, as the Referring Member, simply by marketing and inviting other people that join to become members of We Are Our World will receive zero to ten percent – 0-10% (depending on Your % Invite-A-Friend Settings) of the $Amount of all of their purchases which you can cash out to your personal bank account from all referred members purchases. Each of these referred members will be known as your “Chain of Invited Members” and your earnings will be known as, “We Are Our World Dollars.” These referrals will be easy to obtain by sending out invitation emails to family, friends and other acquaintances through email templates provided by the site and/or by a member supplying a prospective member with their Referral URL and/or any other QR Code, Custom Campaign Link found in the Affiliate Codes section of their Invite-A-Friend Area of their Account section. Then those Invited Members going to weareourworld.com and through the use of these marketing methods will be tracked and the Referring Member will receive Earnings/We Are Our World Dollars for all purchases from their Chain of Invited Members.

There is no limit on how many members you can invite and you will continue to earn We Are Our World Dollars for all of your Referred Members purchases. It is our hope that as each member achieves greater earnings/We Are Our World Dollars that member will in fact, give back even larger contributions towards their desired charities.

Invite-A-Friend eCertificates:
There is a way to gift a good friend and obtain referrals through purchasing a We Are Our World Invite-A-Friend eCertificate in $10, $15 and $20 denomination amounts. Once purchased, just give a friend the eCertificate Code and/or you may use the email templates provided by the site as well. Once in the email templates, a member can simply use the eCertificate radio button and the eCertificate Code will appear in the email to copy and send out to friends. This eCertificate will be tracked through this eCertificate Code and when that friend enters the site, they will be informed about the site, be able to make a purchase and insert the eCertificate Code for a discount in the amount of the eCertificate. As the Original Referring Member you will get credit through the eCertificate Code that was tracked and thus add that member onto your Chain of Invited Members. The new member in turn can do the same, becoming the Referring Member with their friends, and their new members will be tracked, logged, credited to their Chain of Invited Members and thus the cycle continues.

*Note:All We Are Our World Invite-A-Friend eCertificates, once purchased can be sent to as many people as a member wants, but only One New Member can receive a discount off their purchase in the denomination amount of the eCertificate. Therefore, eCertificates are on a First Used basis only and are no longer valid for a discount after one is used.

There are only Two Requirements to be a Member of the Invite-A-Friend Program (IAFP):
1) A Member cannot falsely re-create oneself; in other words, there can only be one individual name, email address and password with a matching members Username. 2) A member’s referrals must make purchases on weareourworld.com for each Referring Member to receive earnings/Invite-A-Friend Dollars.

Member Initiatives (Coming Soon):
A section of the We Are Our World Site where a member can alert the community and raise awareness and monies for their own particular charity of choice through the site and their own events. i.e. marathons, wine tastings, etc.

This is a password-protected area of the site where a member can do any of the following:
See and change their personal information in their Account Profile, access pages to see their Purchase Orders, Cash-Back Rewards, Referrals, Earnings/Invite-A-Friend Dollars, pick their Favorite Charities (coming soon), Email Templates, Purchase and Track eCertificates that may be used for gaining referrals.

Cash-Back Rewards:
This is a section where you can see all of your Orders/Transactions that you have made. You will earn 0-10% (depending on Your % Cash-Back Settings) of your purchase $Amount on every purchase you make that can be used for future purchases on weareourworld.com or cash out to your personal bank account.

Binding Agreements, Suspension and/or Termination:
We Are Our World reserves the right to terminate, temporarily or indefinitely suspend We Are Our World members. If you do not qualify, please do not use our Site. Further, your We Are Our World account and Username may not be transferred or sold to another party. If you are registering as a business entity, you represent that you have the authority to bind the entity to these Agreements. Members acknowledge that We Are Our World is not liable for reimbursement of any items contained within to members who are in violation of these provisions. By registering, you agree to these Agreements, which are final and binding in all respects.

Identity Verification:
We use many techniques to verify the accuracy of the information our members provide us when they register on the Site. However, because member verification on the Internet is difficult, We Are Our World cannot be held responsible for misinformation given on the part of the member.

Release:
You release We Are Our World (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes from any misrepresentation on account of member errors in registering or altering information that is given on behalf of each member.

Information Control:
We do not control the information provided by members that is made available through our system.
Note: That there are also risks of dealing with underage persons or people acting under false pretense. Additionally, there may also be risks dealing with international trade and foreign nationals as they purport their information to be valid and within legal guidelines, rules and regulations within the law or jurisdiction enacted. We Are Our World cannot and will not be held accountable or responsible for the acts and omissions of members on the Site.

Email Communications:
By participating, you agree to receive emails and any other communications from We Are Our World (and/or in conjunction with its Charities) which We Are Our World deems necessary or appropriate in conjunction with the administration of the We Are Our World Services or in connection with any offers or promotions provided by We Are Our World or third parties in a manner consistent with those posted in the We Are Our World Privacy Policy. If you do not wish to receive these communications, we encourage you to opt-out of the receipt of certain communications on your Account Profile Page by choosing which “Email Notifications” you prefer and you may continue to change these at any time.

Fraud:
Without limiting any other remedies, We Are Our World may suspend or terminate your account if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with the Site.

Manipulation:
No member may manipulate the System and Services contained within We Are Our World Site.

Your Information:
Definition – “Your Information” is defined as any information you provide to us in the registration, purchasing, donating or through future correspondents via telephone, mail, email or any other method. You are solely responsible for Your Information as described under the We Are Our World Privacy Policy.

Privacy:
We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent and we only use your information as described in the We Are Our World Privacy Policy. We view protection of members/users’ privacy as a very important community principle. We understand clearly that you and your information is one of our most important assets. We store and process your information on computers located in the United States that are protected by physical as well as technological security devices. We use third parties to verify and certify our privacy principles. If you object to your Information being transferred or used in this way please do not use our services.

Restricted Activities:
Your Information and your activities on the Site shall not;(a) be false, inaccurate or misleading; (b) be fraudulent; (c) infringe any third party’s copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; (d) violate any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising); (e) be defamatory, trade libelous, unlawfully threatening or unlawfully harassing; (f) be obscene; (g) contain any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; (h) create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers.

License:
Solely to enable We Are Our World to use the information you supply us with, so that we are not violating any rights you might have in that information, you agree to grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to exercise the copyright, publicity, and database rights (but no other rights) you have in Your Information, in any media now known or not currently known, with respect to Your Information. We Are Our World will only use Your Information in accordance with our Privacy Policy.

Access and Interference:
The Site contains robot exclusion headers. Much of the information on the Site is updated on a real time basis and is proprietary or is licensed to We Are Our World by our users or third parties. You agree that you will not use any robot, spider, scraper or other automated means to access the Site for any purpose without our express written permission. Additionally, you agree that you will not: (i) take any action that imposes, or may impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure; (ii) copy, reproduce, modify, create derivative works from, distribute or publicly display any content (except for Your Information) from the Site without the prior expressed written permission of We Are Our World and the appropriate third party, as applicable; (iii) interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site; or (iv) bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the Site.

Breach:
Without limiting other remedies, we may limit your activity, immediately remove you, issue a warning, temporarily suspend, indefinitely suspend or terminate your membership and refuse to provide our services to you if: (a) you breach this Agreement, or the documents it incorporates by invitation; (b) we are unable to verify or authenticate any information you provide to us; or (c) we believe that your actions may cause financial loss or legal liability for you, our users or us.

No Warranty:
WE, OUR SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES AND OUR SUPPLIERS PROVIDE OUR WEB SITE AND SERVICES “AS IS” AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. WE, OUR SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES AND OUR SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some states and countries do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights that vary from state to state and country to country.

Limitations of Liability:
We Are Our World is not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any of the equipment or programming associated with or utilized and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the We Are Our World Site. We Are Our World is not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in We Are Our World or downloading materials from or use of the We Are Our World Site. If, for any reason, one or more of the areas of the Site are not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of We Are Our World, could corrupt or affect the administration, security, fairness, integrity or proper conduct We Are Our World reserves the right at its sole discretion to cancel, terminate, modify or suspend such affected to those submitted prior to the action taken, or proceed in such a manner as may be deemed fair and equitable by We Are Our World in its sole discretion.

IN NO EVENT WILL WE ARE OUR WORLD, THEIR PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR SPONSORS, ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE INTERNET SITE WEAREOURWORLD.COM; OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE. OUR LIABILITY AND THE LIABILITY OF OUR SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE GREATER OF THE AMOUNT OF PURCHASES AND MONTHLY CONTRIBUTIONS TO US IN EACH MONTH TO THE ACTION GIVING RISE TO LIABILITY OF ONE-HUNDRED ($100) US DOLLARS. SOME STATES AND COUNTRIES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

Legal Compliance:

No Agency:
You and We Are Our World are independent and no agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended or created by this Agreement.

Taxes:
Your relationship with We Are Our World, LLC. is one of an independent contractor. Therefore, all taxes will be the sole responsibility of each member. No employee-employer relationship is created by your use of our Services and you are fully responsible for filing local, state, federal or any other taxes if applicable on any compensation received as a result of your participation in the We Are Our World Invite-A-Friend Program. All members’ earnings will be sent out through Direct Deposit (ACH) to a member’s bank account. As a member you pick your charities that you would like to contribute to. All donations made to our non-profit charities are being made by We Are Our World, LLC, by taking 0-10% (depending upon Your Charity % Settings) of the $Amount of your purchase and this will not cost a member anything extra. When your annual earnings exceed $500.00 (five-hundred-dollars US Dollars) from that point further you must request and obtain a W9 Taxpayer Identification Number(TIN) Form complete with your full name, home and email address, Member ID and SSN, sign and send it with the information contained in the instructions on the form to: customersupport@wearourworld.com. Once a members W9 TIN Form is received and on file, a confirmation email will be sent to each member and all future monthly earnings will be honored and continued to be paid through Direct Deposit (ACH) to a members bank account.

Notices:
Except as explicitly stated otherwise, any notices shall be given to customersupport@weareourworld.com (in the case of We Are Our World) or to the email address you provide to We Are Our World during the registration process (in your case). Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, we may give you notice by email, certified mail, postage prepaid and return receipt requested, to the address provided to We Are Our World. In such case, notice shall be deemed given 3 days after the date of mailing.

Resolution of Disputes:
As a condition of participating in any of We Are Our World Services; the Invite-A-Friend Program participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with We Are Our World, shall be resolved individually, without resort to any form of class action, exclusively, before a court having competent jurisdiction, which Court shall apply the laws of the State of Delaware without regard to doctrines of Conflict of Law. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (that is, costs associated with participating with We Are Our World), and participant further waives all rights to have damages multiplied or increased. In addition to the above, We Are Our World will consider the use of other alternative forms of dispute resolution, such as mediation, on a case-by-case basis.

General:
This Agreement shall be governed in all respects by the laws of the State of Delaware; as such laws are applied to agreements entered into and to be performed entirely within Delaware between Delaware residents. We do not guarantee continuous, uninterrupted or secure access to our services, and operation of the Site may be interfered with by numerous factors outside of our control. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. You agree that this Agreement and all incorporated agreements may be automatically assigned by We Are Our World in accordance with Section “Notices”, in our sole discretion, Headings are for invitation purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof. Sections Release, License Access and Interference, Liability, Limit, Indemnity, Resolution of Disputes shall survive any termination or expiration of this Agreement.

The services hereunder are offered by We Are Our World, LLC. and we can be reached via email at customersupport@weareourworld.com or by writing to us at We Are Our World, LLC. Commercially available parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist you in limiting access to material that is harmful to minors.
